A Western Australian construction company has received a record $1.75 million fine following the death of a worker who was struck by a falling structural steel column at a construction site.

The investigation found the lifting device involved was not compliant with Australian lifting standards. It was not rated, marked with a working load limit, or supported by inspection, testing or maintenance records. Despite the company’s directors being aware the equipment was not compliant, it remained in use.

The case highlights that plant and equipment should never be assumed safe simply because it has been used before. Regular inspections, maintenance records and removing defective equipment from service are essential parts of an effective safety management system.

Importantly, the Court also reinforced that safe work procedures must not only exist but be implemented, communicated and consistently followed by workers on site.

For employers, the key lesson is that overlooking known hazards or delaying action can have devastating consequences for workers and significant legal consequences for businesses and workplace leaders.

To help reduce risk, employers should:

  • Regularly inspect and maintain plant, equipment and lifting devices.
  • Remove damaged, defective or non-compliant equipment from service immediately.
  • Keep inspection, maintenance and testing records up to date.
  • Ensure workers understand and follow safe work procedures.
  • Regularly review high-risk work activities and associated controls.
